General Provisions, Our Services and Content, Agreement to be Bound by Terms

GetFive LLC (“we” or “us”) provide the Site, our outplacement and career development services, other related services and technologies, and all “Content” (as defined below) contained therein, whether now or in the future (collectively the “Services”), to each visitor or registered user, as the case may be (each a “user” or “you”), subject to this Privacy Policy (the “Privacy Policy”). For the purposes of the Privacy Policy, the term “Content” includes, without limitation, any documents, materials, advertisements, job postings or leads, reports, advice, suggestions, videos, audio clips, written forum comments, information, data, text, photographs, software, source code, scripts, graphics, images and interactive features generated, provided, or otherwise made available by us or accessed through the Services. This Privacy Policy sets forth our policy with respect to personally identifiable information (“PII”) and other non-personally identifiable information that is collected, transmitted and otherwise used in connection with the Services. By using or accessing the Services in any manner, you agree to be bound by this Privacy Policy and our Terms of Use, and further agree and consent to our collection, transmission and use of your PII and other information as described herein and in any other policies, documents or notices we may provide to you from time to time concerning the Services. If you do not agree with this Privacy Policy or our Terms of Use, you must not use the Services.

We reserve the right to modify or revise our Privacy Policy and/or other policies we may have at any time at our sole discretion. Any such revisions or modifications to the Privacy Policy shall be effective when posted and you are bound by and shall be deemed to have accepted any revisions or modifications to the Privacy Policy when you use the Services after those revisions or modifications have been posted. As users are bound by such modifications or revisions, you should visit this page frequently to review the Privacy Policy. In the event that you do not agree to any changes or modifications of the Privacy Policy, you must discontinue using the Services.

PII Collected from You

If you choose to use the Services, we may ask you to provide us with certain PII, including without limitation: (i) your name, recent job title, company name, telephone numbers, address, email address and other identification or contact information; (ii) your job history and other experience, education and training, other qualifications, employment objectives, compensation expectations, interests, and other career and biographical information; (iii) information on your progress and status in job searching; and (iv) information on your customer satisfaction or other feedback about the job search and the Services. We may also collect other PII from you when you voluntarily provide such information, such as when you contact us with inquiries or when you make purchases through the Site or Services.

You may provide PII through various channels in connection with the Services, including, when you activate your account for the Services (whether via online registration, telephone registration or paper form), if you provide us with your résumé, if you complete checklists and/or questionnaires, during training, coaching and/or counseling sessions, discussions, exchange of email and other channels.

For your online account that you may establish through the Services, we may ask you to establish a unique user name, password and reminder question and use this login information to access your account. While we use reasonable measures to protect the PII contained within your online account and stored within our database, please note that we cannot guarantee the security of such PII. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of such PII at any time. We will endeavor to notify users in the event that the security of their PII is breached or compromised. By submitting PII through any of the Services, you expressly consent to receiving our notification regarding any breach or compromise, or suspected breach or compromise, of the security of your PII, by email or postal mail, as we deem appropriate, and as required by law. You agree to protect the secrecy of your user name, password and reminder question information, and if you fail to maintain that secrecy, you will be fully responsible for any resulting use, theft, alteration, misuse, disclosure or other loss related to your PII. As such, we urge you to keep your username, password and other account access information in a safe place and not to divulge it to anyone. Also, remember to sign out and close the Services when you have finished your visit. This is to ensure that others cannot access your account, especially if you are sharing a computer or mobile device with someone else or are using a computer or mobile device in a public place such as a library or an internet café.

PII Received Pursuant to Outplacement Engagements

You acknowledge that companies may engage us to assist their current and/or former employees in obtaining employment through the Services (“Outplacement Engagements”). In connection with Outplacement Engagements, we receive a list of persons eligible for the Services, and, if you are an eligible person, such list may include various PII, including, but not limited to, your name, recent job title, home address, telephone number, email address, department or business unit. By providing us with your PII or otherwise using the Services (including as a part of an Outplacement Engagement), you are consenting to our use of your PII (whether collected from you or received pursuant to an Outplacement Engagement) in accordance with this Privacy Policy. You further acknowledge and agree, that any such PII may be transferred from your or its current location to our offices and servers and any authorized third parties referred to herein located in the United States or other countries.

Other Information We Collect; Cookies & Alternative Tracking Devices

When you use the Services, we log certain non-personally identifiable information about your use of the Services, including, but not limited to, IP address, profile information, pages visited, and browser type. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you and is used to, among other things, provide customized content to users, provide targeted offers to users, manage the site, track usage and improve the site services. This non-personally identifiable information may be shared with third parties to provide more relevant services and advertisements to users. User IP addresses are recorded for security and monitoring purposes. We may also aggregate information for the purpose of user analyses and inform third parties of the results of such analyses. In all such instances, we will refer only to general, aggregate usage data from these analyses and will never provide specific identifying information. We may also disclose aggregated usage data in order to describe the Services to current and prospective business partners, and to other third parties for other lawful purposes. We may store non-personally identifiable information itself or such information may be included in databases owned and maintained by our affiliates, agents or service providers.

We use cookies to store users’ preferences, account status, traffic origination and to record session information. We do not link the information we store in cookies to any PII you submit while using the Services. You may be able to configure your browser to accept or reject all or some cookies, or to notify you when a cookie is set. As each browser is different, check the “Help” menu of your browser to learn how to change your cookie preferences. However, if you disable cookies, you may be unable to use many of the features and functions available on the Site and through the Services. Third party service providers (if any) on the Services may have the ability to set and access their cookies on your computer, and the use of cookies by any third party service providers on the Services are subject to their respective privacy policies and are not subject to this Privacy Policy.

We may also use other industry standard technologies like pixel tags and web beacons to track your use of the Services and promotions, or we may allow our third party service providers to use those devices on our behalf. Pixel tags and web beacons are tiny graphic images placed on certain pages on the Services, or in our emails that allow us to determine whether you have performed a specific action. When you access these pages or open or click an email, pixel tags and web beacons generate a non-personally identifiable notice of that action. Pixel tags allow us to measure and improve our understanding of visitor traffic and behavior while using our Services, as well as provide us a way to measure our promotions and performance. We may also utilize pixel tags and web beacons provided by our affiliates or third party service providers for the same purposes.

Links to Other Sites and Sharing Tools

The Services may contain links to other websites, applications and services maintained by third parties that may not follow the same privacy policies as the Services. For instance, clicking on a third party logo or advertisement will take you to an entirely different site, application or service. These sites, applications and services may use cookies, collect data and use the data in ways that we would not. We are not responsible for the privacy policies and/or practices on other sites. When linking to another site, a user should read the privacy policy stated on that site. Our Privacy Policy only governs information collected by or through the Services. Furthermore, we bear no responsibility for any offensive material or violations of law on any site linked from the Services.

The Services may also include tools that allow you to sign in or comment using information from your accounts with third party services, such as Facebook, Twitter, Google or Yahoo. Please be aware that those third party services are unrelated to the Services and that your use of the third party services is subject to the terms and policies of those services.

How We May Use and Share Your PII

In general, we will use your PII in order to provide the Services to you, including identifying what aspects of the Services you are interested in or seeking. If you are using the Services to obtain employment, we will use your PII to identify and provide job leads, and to suggest or provide job search training, résumé-writing assistance and/or other assistance. We also use your PII to identify and authenticate you when you access the Services or communicate with us concerning the Services. We may also use your PII to review and evaluate your account and use of the Services, assess the performance of the Services, improve the Content and functionality of the Services, provide training to our personnel and/or otherwise manage the Services, the Site and our business.

In addition, if you provide PII for a specific reason or purpose, we may use the PII for the reason or purpose for which it was provided. For instance, if you contact us with questions, we will use the PII provided to us to answer your question or to resolve your problem.

We may also use and share your PII, as follows:

• We may use third party providers to process payments or assist in providing other services to you, and may share your PII with these third party providers as is necessary for them to perform the tasks/services they provide. For example, when you make any purchase through the Services, you will be asked to enter your first and last name, credit card information, and billing address as necessary to complete your transaction, and we may share this information with a third party in order to process your payment. In such event, the third party service providers have agreed to be bound by this Privacy Policy and to only use the PII shared with them for the intended purpose. We do not store any user’s credit card information in our database.
• We may transfer, disclose or sell your PII as part of (i) a business divestiture, sale, merger, or acquisition of one or more of our Services; or (ii) a business divestiture, sale, merger, or acquisition of GetFive LLC as a whole or substantially all of its assets.
• We may share your PII with one or more of our affiliates for purposes consistent with this Privacy Policy.
• We may engage other companies to perform services relating to the management of our business, such as analytics. If we engage another company to perform any such services, we may provide them with your PII to the extent necessary or useful for them to perform their specific function. Any such companies with whom we share your PII have agreed to be bound by this Privacy Policy and to only use the PII shared with them for the intended purpose.
• We may share your PII if you request to be contacted with additional information, materials or special offers from third parties.
• We may also disclose your PII if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by us; (ii) enforce our Terms of Use or to protect our rights; (iii) protect the safety of members of the public and users of the Services; or (iv) protect against legal liability.

Management of PII and Other Information

We may receive or store your PII and non-personally identifiable information in digital form and may combine all PII and non-personally identifiable information from or about you into a single record, which may be stored on servers hosted in the United States or in other countries. From time to time we may ask you to confirm the accuracy of and/or to update your PII to ensure that our records remain up to date. Our employees, staff and/or personnel may access your online account in the course of providing the Services to you and, if you are using the Services to obtain employment, post job postings to your online account.

We take reasonable steps to protect your PII and other information from loss, misuse, and unauthorized access, disclosure, alteration or destruction. Internet or email transmission, however, are never fully secure or error free, and email or other transmissions sent to or from the Services may not be secure. You should keep this in mind when determining what information you send to us via email or any other transmission method, and when providing any PII or other information to us via the Internet.

Exclusions

This Privacy Policy does not apply to any PII other than PII obtained by us through the Services, and shall not apply to any unsolicited information you may provide to us through the Services or other means. This includes, without limitation, information posted to any public areas of the Services, ideas for new products or services or improvements to existing products or services and other unsolicited submissions. Moreover, we shall be free to use, disclose, reproduce and distribute such unsolicited information to others without limitation or attribution.

Changes in Our Privacy Policy

From time to time we may make changes to our Privacy Policy. If we make changes, we will post them on the Services to make users aware of what the changes are so that users will always be aware of what information we collect, how we use it and when we may disclose it. A user is bound by any changes to the policy when he or she uses the Services after those changes have been posted. If, however, we intend to disclose users’ PII in a manner different from that stated at the time of collection, we will post a notice of such intent on the Services thirty (30) days prior to such action.

Correcting/Updating Information and Terminating Registration

Registered users may modify any PII contained in their online account at any time by logging into their online account and editing such PII. Registered users may terminate their registration at any time, for any reason, by contacting [email protected]. The user understands that it may be impossible to delete PII entirely because of backups and records of deletions.
